ADMINISTRATIVE REGULATIONS

PURPOSE

 

To set forth guidelines for the development, review, approval and distribution of Administrative Regulations for the Department of Corrections.

 

AUTHORITY:          

 

NRS 209.131;   NRS 209.391

 

RESPONSIBILITY

 

The implementation of this regulation is the responsibility of the Director of the Department of Corrections. and the

designated Chairperson of the Administrative Regulation (AR) Committee

 

DEFINITIONS

 

Administrative Regulation – A written policy of the Department of Corrections which has been approved by the Board of Prison Commissioners

 

Draft Regulation – A document under development as an Administrative Regulation, yet without force as policy.

 

Temporary Administrative Regulation – A written policy of the Department of Corrections which has been approved by the Director of the Department but is , yet which is awaiting the final approval byof the Board of Prisons Commissioners.  A temporary AR has the force of policy for a period of 12 months in which to obtain the final approval of the Board. 

 

Draft Regulation – A document under development as an Administrative Regulation that has not been approved by the Director of the Department and is without the force of policy.

 

100.01               DEVELOPMENT OF ADMINISTRATIVE REGULATIONS

 

1.      The Director will designate a Departmental Policy Coordinator establish an Administrative RegulationAR Committee to promulgate written policy for the Department.

 

2.      The Policy Coordinator  Committee may assign appropriate staff content experts to write policy and procedure.

 

3.      The Policy Coordinator Committee will establish a general standard format for the publication of regulations.

 

4.      Any staff person may recommend a change or addition to a regulation, through the Policy Coordinator. AR Committee. (3-4004)

 

5.      Draft regulations should be reviewed by affected staff and the designated staff of the Attorney’s General Office.

 

6.      A DdDraft Rregulation egulationmay bewhich has been signed by the Director, which has been signed by the Director, becomes a Ttemporary Rregulation with the force of policy for 12 months to have the force of a temporary regulation,while pending the approval of the Board of Prison CommissionersCommissioners is pending. 

 

1.A dTtemporary raft Rregulation should be approved by the Board within 12 months of its signing by the Director.

8.      All draft Ttemporary and Board approved AR’s AR’s relating to health care services should be co-signed by the Director and the Medical Director and signed by the Director..

 

 

1.            Administrative Regulations (AR’s) will be organized in a manuals with the following chapters:

·        100 series – General Administration

·        200 series – Fiscal Management

·        300 series – Personnel

·        400 series – Institutional Management

·        500 series – Classification & Management of Inmates

·        600 series – Health Care Services

·        700 series – Inmate Regulations

·        800 series – Inmate Programs

·        900 series – EEO / Employee Development

 

10.  AR’s approved by the Board after 11.01.05, are public documents and will not contain procedures which affect security and are thus confidential.

 

11.  11. AR’s should be placed in all inmate law libraries, and be made available to interested parties via onf the Department’s web site. and NOTIS [what does this stand for?].

 

100.02               UPDATING ADMINISTRATIVE REGULATIONS

 

1.      AR’s may be revised as necessary, without schedule.

 

2.      AR’s should be reviewed by the Committee every three years for updates.

 

3.      An AR is effective until it is replaced by a Temporary Regulation, or until a revised AR is approved by the Board.

 

100.03                        DISTRIBUTION & IMPLEMENTATION OF ADMINISTRATIVE                                        REGULATIONS

3.Regulations An AR is are effective until it is replaced by a temporary regulation, or until upon approval of a revised AR is approved by the Board. 

 

 

 

 

 

1.      The Policy Coordinator should maintain Director will assign a staff person to maintain and distribute AR’s and Ttables of Ccontent to Division heads.

 

2.      Division heads will carry out a distribution ofdistribute AR’s to their subordinate staff, as appropriate, to and insure accessibility to all employees and volunteers.  (3-4015)

 

2.Division heads will insure that staff staff is is trained in regarding AR’s affecting their employment.

3.       

 

4.       The 500, 600, 700, and 800 series of AR’s should be translated into Spanish. 

 

5.      The establishment of these regulations does not create any right, or liberty or property interest, liberty or property, or establish the basis for any cause of action against the State of Nevada, its political subdivisions, agencies, boards, commissions, departments, officers or employees.

 

6.      These regulations do not create any liberty interest, or nor a right to any classification status, employment or placement, on behalf of inmates, nort is any liberty interest in favor of any inmate to be implied from any part of these regulations. 

 

7.      Divisions, institutions, and facilities should will establish Operating Procedures to implement the requirements of AR’s to their operations and environment.  (3-4014)

 

100.04             APPLICABILITY

 

1.      This regulation does require Operating Procedures for each Division, institution and facility.

 

2.      This regulation does require an audit.
